Individual versus joint divorce applications: what's the difference? When filing for divorce, there is a choice between an Individual Petition or a Joint Petition. An Individual Petition involves one party to the marriage initiating the process on their own, usually by providing their Individual Remission Certificate or Health Card. On the other hand, a joint petition involves both parties signing the petition. The advantage of a joint application is that there is no need to prove that the application has been served on the other party. This allows the court to streamline your filing process (which we discuss in depth in the Hearings section). However, we have observed that approximately 801 TP3T applications are individual, due to the challenges of both parties working together during the separation.
Essential information required for your divorce application In order for a divorce application to be successfully processed, specific information is required. This includes:
Full names of both parties.
Date and place of marriage.
Date of marriage and separation.
The period during which the parties live together after separation.
Is there an opportunity for reconciliation (yes, this question is important).
Whether there were minor children during the application period, which also includes children from previous relationships or other family members.
Detailed information about the children: their health, education, financial support and time allocation with parents.
Any past court orders relating to children, property or family matters.
How to File Your Divorce Petition Online In the past, you were required to file multiple paper copies with the Family Court. But now, with advances in technology, the Federal Circuit allows electronic filing through the Federal Portal. Here, you can easily upload scanned copies of your petition and related documents. Once the initial process on the portal is complete, you can finish filing and a hearing date will be scheduled. Stay tuned for our subsequent sections on the post-filing process.
