How do I get a reduced filing fee in Family Court?

The financial aspects of a legal process like divorce can be challenging. Fortunately, the Family Law (Fees) Regulations 2022 make provision for individuals who may struggle to afford standard fees. If you are considering applying for a divorce or an annulment, here's what you need to know about possible fee reductions.

Are you eligible for a fee reduction? The following conditions highlight the various circumstances in which an individual may qualify for a reduced application fee:

If you hold any of the following:

medical card

Pension Discount Card

Federal Senior Health Card

Other cards indicating eligibility for federal health benefits

Current status as a prisoner or detained in a public institution

Under 18 years of age

Beneficiaries of Youth Allowance or Austudy

Recipients of ABSTUDY benefits

Alternatively, if demonstrating payment of the full fee would result in financial hardship, based on the parameters set out in reg 2.06(2) of the Family Law (Fees) Regulations 2022.

For individuals who meet any of the above criteria, the filing fee is approximately 30% of the normal divorce filing fee, payable at the time of filing.

If the above categories do not apply, then reg 2.06(2) and (3) of the Family Law (Fees) Regulations 2022 covers situations where financial hardship can be a valid reason for a fee reduction. Fee reductions may be available if normal fees are found to be putting a strain on your finances, taking into account your income, daily expenses, debts and assets. To help with this process, people on low incomes can complete the "Application for Reduction of Payment for Divorce or Invalid Judgement - Financial Hardship".
