← Professional executor & trustee services across Australia

Chua Tan Associates acts as independent executor, trustee and administrator for estates with assets in Tasmania. Tasmania has the shortest family provision deadline in Australia and its own publication steps, so early advice matters.

Probate in Tasmania

  • Grants are made by the Probate Registry of the Supreme Court of Tasmania in Hobart under the Administration and Probate Act 1935.
  • Before filing, a notice of intention is published on the Court’s website, and a further notice in the Government Gazette and two newspapers. The application can be filed 14 days after both are published.
  • Overseas grants: if probate has already been granted overseas, it may be possible to reseal that grant in Tasmania; otherwise a fresh Tasmania grant is needed. Which applies depends on where the grant was issued, so we confirm the right path with the Registry and prepare the notarised and translated evidence.

Executor’s commission

The Supreme Court may allow commission that is just and reasonable, up to 5 per cent of the estate. We explain the basis of our fees in writing before you sign your Will.

When an adult loses capacity: TASCAT

The Tasmanian Civil and Administrative Tribunal (TASCAT), Guardianship Stream, appoints an administrator under the Guardianship and Administration Act 1995. An administrator can be a relative or friend, a solicitor or accountant, the Public Trustee or a trustee company. Administrators report to TASCAT each year, and orders usually last three years before review.

Where family members disagree, live overseas or have a conflict, we are available for appointment as an independent administrator.

Family provision: three months

Under the Testator’s Family Maintenance Act 1912, a claim must be started within three months of the grant — half the time allowed in Victoria. The Court can extend time, but only before the estate is finally distributed. Executors should hold distributions until the period has passed.

The government alternative

The Public Trustee (Tasmania) can act as executor or administrator. Families choose a private professional when they want a named contact, cross-border coordination and service in Mandarin or Cantonese.
