The application can be filed 14 days after both are published.<\/li>\n<li><strong>Overseas grants:<\/strong> if probate has already been granted overseas, it may be possible to reseal that grant in Tasmania; otherwise a fresh Tasmania grant is needed. Which applies depends on where the grant was issued, so we confirm the right path with the Registry and prepare the notarised and translated evidence.<\/li>\n<\/ul>\n\n<h2>Executor&#8217;s commission<\/h2>\n<p>The Supreme Court may allow commission that is just and reasonable, <strong>up to 5 per cent<\/strong> of the estate. We explain the basis of our fees in writing before you sign your Will.<\/p>\n\n<h2>When an adult loses capacity: TASCAT<\/h2>\n<p>The <strong>Tasmanian Civil and Administrative Tribunal (TASCAT)<\/strong>, Guardianship Stream, appoints an <strong>administrator<\/strong> under the <em>Guardianship and Administration Act 1995<\/em>. An administrator can be a relative or friend, a solicitor or accountant, the Public Trustee or a trustee company. Administrators report to TASCAT each year, and orders usually last three years before review.<\/p>\n<p>Where family members disagree, live overseas or have a conflict, we are available for appointment as an independent administrator.<\/p>\n\n<h2>Family provision: three months<\/h2>\n<p>Under the <em>Testator&#8217;s Family Maintenance Act 1912<\/em>, a claim must be started within <strong>three months of the grant<\/strong> \u2014 half the time allowed in Victoria. The Court can extend time, but only before the estate is finally distributed. Executors should hold distributions until the period has passed.<\/p>\n\n<h2>The government alternative<\/h2>\n<p>The <strong>Public Trustee<\/strong> (Tasmania) can act as executor or administrator.
