Before finalising a divorce, the court will scrutinise whether adequate provision has been made for the health, upbringing and day-to-day care of the children (refer to s 55A in family law). The court may not grant a divorce order unless it is confident in asserting that None of the children of the marriage are under the age of 18.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Where there are children under the age of 18 in the marriage, the divorce order must specify them and ensure that their care, welfare and development are properly catered for. Furthermore, even if the court finds these arrangements inadequate, valid grounds for granting a divorce should still exist (under s 55A(1)).\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">If the court has reservations about the arrangements for the children, it may: make a divorce order despite the inadequacy of the arrangements; or delay the proceedings and require an affidavit setting out the arrangements for the care of the children. At a subsequent hearing, once the court has received assurances, it may grant the divorce. Defining 'children of the marriage' in the context of divorce In divorce proceedings and family law, a 'child of the marriage' is defined as a child whom the couple regarded as part of their family before the event of separation (s 55A(3), (4)). This definition includes a child born outside the marriage to either spouse, a child not biologically related to either spouse, or a child adopted by the couple.
