Since 9 December 2017, Australia has recognised the right of same-sex couples to apply for a divorce in Australia, even those married overseas.<\/span><\/p><p><span style=\"font-weight: 400;\">Looking back In the past In the past, Australian law did not recognise the marriages of same-sex couples, let alone give them the right to divorce. This gap in family law created many difficulties and left some couples stuck in unions they wanted out of for a variety of reasons.<\/span><\/p><p><span style=\"font-weight: 400;\">A breakthrough in the law Under the Family Law Act 1975 (Cth), same-sex couples now have a clear pathway to legally end their marriages if they believe they have met certain conditions. This is an important step forward in ensuring that the rights and dignity of all couples are upheld, regardless of their sexual orientation. Going further, this change is not limited to couples married in Australia. Part VA of the Marriage Act 1961 further explores the recognition of valid marriages when married abroad.
