He has lodged an onshore employer-sponsored visa application, but no decision has been made. He worries: will he become unlawful when his old visa expires, and can he keep working and visit family overseas? The answer: if he lodged a valid onshore application while his old visa was still in effect, he will usually be granted a Bridging Visa A, which comes into effect when the old visa expires and keeps him lawful until the new application is decided. Whether he can travel or work depends on the type of bridging visa and its conditions.

At a glance

Bridging Visa A (BVA): granted when you lodge an onshore application while holding a substantive visa; it takes effect when that visa ends.

Bridging Visa B (BVB): the only bridging visa that lets you leave and return to Australia during processing; it must be applied for separately.

Bridging Visa C (BVC): granted where you had no substantive visa when you lodged (but were not unlawful); it generally has no work rights at first.

Bridging Visa E (BVE): for people who have become unlawful or are making arrangements to depart; conditions are usually stricter.

If you leave Australia on a BVA or BVC, the bridging visa ceases immediately and cannot be used to return.

Bridging Visa A: the most common situation

If you hold a student, graduate, work or other substantive visa and lodge another visa that can be applied for onshore, you will usually be granted a BVA at the same time. The BVA is granted when you lodge, but only comes into effect when your current visa expires. Until then, the conditions of your current visa still apply.

On work rights, BVA conditions are usually linked to the type of visa you have applied for and the work rights on your previous visa. In many cases a BVA allows work, but there are exceptions. Check the specific conditions in VEVO or your grant notice rather than assuming. If your BVA carries condition 8101 (no work), you may be able to apply for a new bridging visa with different conditions if you meet the criteria, for example financial hardship.

Bridging Visa B: when you need to travel

A BVB lets you leave Australia during processing and return once within a specified travel period. You generally need to hold a BVA or BVB, apply in Australia and explain a substantial reason for travel, such as visiting a seriously ill relative, attending a funeral or work commitments. The BVB must be granted before you depart; if you leave without one, your existing bridging visa ends and you may not be able to return to Australia to await the decision. Watch the travel period carefully: if you return after it ends, the BVB can no longer be used to enter.

Bridging Visas C and E: more complicated situations

If you lodge an application when you do not hold a substantive visa but are not unlawful (for example, you hold another bridging visa at the time), you may be granted a BVC. A BVC usually has no work rights and does not allow you to leave and return. If you can show a compelling need to work because of financial hardship, you can apply for a BVC with work rights.

A BVE is for people who have become unlawful and want to regularise their status or prepare to depart, and for some people seeking ministerial intervention or judicial review. BVE conditions are usually stricter and may include reporting to the Department and no work. If you have become unlawful, seek advice quickly, because the longer you remain unlawful, the more limited your future visa options become.

What happens to the bridging visa if the application is refused?

A bridging visa does not end the moment your application is refused. The law allows a period to seek review or arrange departure. If you apply to the Administrative Review Tribunal (ART) for review within time, the bridging visa generally continues until a period after the review decision. If you do not seek review, you should depart or obtain another visa before the bridging visa ends. Check the exact timeframes stated in your refusal letter.

Another situation that is easily overlooked: if your new application is refused or withdrawn while your current visa is still in effect, the bridging visa may never come into effect. You remain on your current visa and must depart or make other arrangements before it expires. Take particular care when changing your application strategy close to your visa expiry date.

Practical checklist

Lodge your new application before your current visa expires and confirm which bridging visa you received.

Check work and study conditions in VEVO and share the result with your employer.

Allow time to apply for a BVB before any travel and book flights only after it is granted.

Update your address and contact details with the Department so you do not miss important letters.

If refused, note the review deadline immediately.

FAQs

Can I enrol in Medicare on a bridging visa?

It depends on the visa you have applied for. For example, people who have applied for a partner visa or certain permanent visas can usually enrol, while applicants for other temporary visas generally cannot. Confirm with Services Australia.

What happens if I lodge another visa application while on a BVA?

You may be granted a new bridging visa whose conditions differ from, and may be less favourable than, your existing one, for example without work rights. Before lodging a second application, check how it would affect your bridging visa conditions.

Can I travel multiple times on a BVB?

Each BVB generally allows one departure and return within the approved travel period. For another trip, you will usually need to apply for a new BVB.

My bridging visa is not yet in effect. Can I work under the new conditions?

No. Until your current visa expires, its conditions still apply, such as student visa work hour limits. Do not give your employer a bridging visa that is not yet in effect as proof of work rights.

Chua Tan Associates has practised in Melbourne since 1990 and advises on immigration law in Mandarin, Cantonese and English.
