When a family member dies, the executor named in the Will often needs a grant of probate from the Supreme Court of Western Australia before the estate can be dealt with.

Often the executor is not in Perth at all, but a child working in Singapore or a sibling in Kuala Lumpur. This guide explains the probate WA requirements, how the application is made, how long it usually takes, and how executors who live overseas, or their attorneys, can apply.

When is probate needed in Western Australia?

A grant gives the executor legal authority to deal with the deceased’s property. The Supreme Court of WA says a grant is usually needed where the deceased held assets in WA in their sole name, such as bank accounts, shares or real estate, or owned real estate as tenants in common with someone else.

A grant may not be needed where:

real estate was held as joint tenants, so it passes to the survivor through a Landgate application;

bank accounts were joint, so the survivor can usually access them with a death certificate;

the only assets are personal belongings, or a car or motorbike.

The Court can only make a grant if the deceased left assets in WA. If the person lived in WA but held everything overseas, the WA Court will not issue a grant. Banks, super funds and insurers will tell you what they require, so contact them early.

Types of grant

Probate: where there is a Will naming an executor who applies.

Letters of administration with the Will annexed: where there is a Will but no executor is named, or the named executor cannot or will not apply. Usually granted to a beneficiary.

Letters of administration: where there is no valid Will. Usually granted to a person entitled to share in the estate.

Probate WA requirements: documents and information

Before applying, gather:

the original Will and any original codicil, without removing staples or attaching clips;

the original death certificate;

any signed consents or renunciations from other executors;

the full names and current addresses of the Will’s witnesses;

the deceased’s full name, any other names used, last address, and marital status when the Will was signed;

details of every asset and liability at the date of death, such as property addresses, share holdings, bank balances and vehicle details.

The application itself consists of a motion, a supporting affidavit and a statement of assets and liabilities.

The probate WA application, step by step

Wait at least 14 days after the death. Under WA’s probate rules, an application can be made at any time after 14 days from the death. Unlike NSW and Queensland, the Court’s guidance does not require a notice of intended application to be published before an ordinary probate application.

Prepare the documents. For straightforward estates, the Supreme Court’s online Probate Wizard asks a series of questions and prepares the application for you to print. It is not suitable if there is no Will, only a copy of the Will, the applicant is not a named executor, the Will was not properly signed and witnessed, or there are no WA assets. Those cases need legal advice.

Sign before a witness. Sign the application and have the affidavit sworn or affirmed before an authorised witness.

File with the Probate Registry. File in person or by post at the Supreme Court in Perth, with the original Will and death certificate and the filing fee. Registered post is recommended. The Court keeps the original Will.

Answer requisitions. A Registrar reviews the application and may issue a requisition asking for more information. The application cannot progress until it is answered, so give the Court an email address.

Receive the grant. The grant is posted to you, or you can choose to collect it from the Registry.

How long does probate take in WA?

The Court aims to process applications within about four weeks, and its online form guidance suggests allowing three to six weeks. Complex applications and requisitions take longer.

Distribution takes longer than the grant. In WA, a family provision claim must be made within six months of the grant of probate or letters of administration. Extensions are possible but uncommon. Executors therefore usually hold the estate until that period has passed. Legal Aid WA describes about a year as generally a reasonable time to complete an estate.

Overseas executors and applying through an attorney

WA’s Administration Act 1903 includes several rules that matter when an executor lives abroad.

Applying yourself from overseas. An executor living outside WA can apply. Their affidavit must be sworn before an authorised person where they live, such as a notary public or Australian consular officer. A non-resident executor must also give the Court an address for service in WA before the grant is issued.

Applying through an attorney. Where the executor or other person entitled to the grant is outside WA, the Court can grant administration to their attorney, on behalf of that person and on terms the Court sets. This is often a practical option for families in Asia, but the power of attorney must be suitable for the purpose. A general power made overseas for other reasons may not be enough.

Administrator in place of an absent executor. Where the executor lives outside WA, the Court can appoint an administrator with the Will annexed. If the executor is still outside WA six months after the death and the estate is at risk, a creditor or interested person can seek a special grant.

Resealing a grant from elsewhere. A grant from another Australian state, or from certain other Commonwealth jurisdictions, may be resealed in WA so that it has the same effect as a local grant. Whether a grant from your country qualifies needs to be checked. Many Asian jurisdictions do not.

Wills in another language. A Will in Chinese, Malay or Bahasa Indonesia will need a proper translation and supporting evidence.

Checklist for executors of a WA estate

Confirm the deceased had assets in WA and how each was held.

Find the original Will and obtain the original death certificate.

Decide whether you will apply personally, through a lawyer, or through an attorney.

If you are overseas, arrange for a notary or consulate to witness your affidavit and give an address for service in WA.

Diarise the six-month family provision period, which starts from the grant.

Arrange the deceased’s final tax returns and get tax advice before selling assets, noting that Australia’s capital gains tax rules change from 1 July 2027.

Frequently asked questions

What are the probate requirements in WA?

You need the original Will, the original death certificate, details of the deceased’s WA assets and liabilities, and the witnesses’ details. The application is filed as a motion with an affidavit and a statement of assets and liabilities, and the deceased must have left assets in WA.

Can I apply for probate online in WA?

You can prepare a straightforward application using the Supreme Court’s online Probate Wizard. You then print, sign and have it witnessed, and file it with the original Will at the Registry in person or by post.

How long does probate take in WA?

The Court aims to deal with applications in about four weeks, though three to six weeks is a realistic range and requisitions add time. Most executors then wait for the six-month family provision period after the grant before distributing.

Can someone apply for probate in WA on behalf of an overseas executor?

Yes. WA law allows the Court to grant administration to the attorney of an executor who is outside the State, on behalf of that executor. The power of attorney needs to be suitable, and the Court can impose conditions.

How Chua Tan Associates can help

We assist executors and families with Western Australian estates, particularly where the executor lives in Singapore, Malaysia, Hong Kong, Indonesia or elsewhere overseas. We advise whether a grant is needed, prepare the application, deal with requisitions, and can arrange a suitable power of attorney so that an attorney in Australia can apply on the executor’s behalf.
