31．什么是行政复核审裁庭（ART）？

行政复核审裁庭（Administrative Review Tribunal，简称 ART）是澳洲一个独立机构，用于重新审查移民局作出的决定。

ART 可以复核的决定包括：

  • 签证拒签（Visa Refusal）
  • 签证取消（Visa Cancellation）
  • 担保申请拒绝
  • 部分公民申请拒绝

ART 属于**“实质性复核（Merits Review）”**，意味着它可以重新审查事实、证据与法律适用，并作出新的决定。

申请人通常可以：

  • 提交新证据
  • 解释个人情况变化
  • 出席听证会
  • 提交法律陈述

 

32．我可以对签证拒签提出ART上诉吗？

在很多情况下是可以的，但必须符合条件。

一般来说，你需要满足：

  • 在澳洲境内递交的签证申请（onshore application）
  • 拒签通知中明确说明有复核权
  • 在法定期限内递交申请（通常为21至28天）

⚠ 逾期申请通常会失去上诉权。

因此时间非常关键。

 

33．ART听证会会发生什么？

ART听证会是一个正式但相对灵活的法律程序。

审理过程中，法庭会考虑：

  • 移民局原始决定
  • 申请人提交的证据
  • 法律论点
  • 申请人或律师的陈述

申请人可能需要回答审裁员的问题。

ART最终可能作出以下决定：

  • 维持原拒签决定
  • 更改原决定
  • 撤销拒签并批准签证
  • 发回移民局重新审理

 

34．在ART阶段可以提交新证据吗？

可以，而且这是ART程序的重要特点之一。

常见新证据包括：

  • 最新工作证明

  • 医疗报告
  • 品格证明信
  • 康复或改过证据

但必须遵守程序规则，并在规定时间内提交。

35．ART复核与法院上诉有什么区别？

两者性质完全不同：

✔ ART复核（行政复核）

  • 重新审查事实与证据
  • 可以做出新决定
  • 程序较灵活
  • 可以重新考虑整个案件

✔ 联邦法院上诉（司法复核）

  • 不重新审查事实
  • 只审查法律错误
  • 判断移民局或ART是否“依法作出决定”

简单理解：

👉 ART = 是否做出“正确决定”
👉 法院 = 是否做出“合法决定”

 

36．什么是司法复核（Judicial Review）？

司法复核是向联邦法院提出的法律程序，用来挑战移民决定是否合法。

法院审查的重点包括：

  • 是否超越法律权限
  • 是否程序不公平
  • 是否错误适用法律
  • 是否忽略关键证据
  • 是否存在管辖权错误

⚠ 法院不会直接批准签证，只会判断原决定是否合法。

如果成功，案件可能被发回重新审理。

 

37．我可以直接向联邦法院提出上诉吗？

不能直接随意提出。

必须满足条件，例如：

  • ART复核失败
  • 或原决定属于可司法复核范围

同时必须：

  • 在严格时间内递交（通常很短）
  • 提出明确法律错误理由
  • 准备完整法律文件

这类案件通常需要专业移民诉讼律师处理。

 

38．什么是“管辖权错误”(Jurisdictional Error）？

管辖权错误是移民诉讼中最重要的法律概念之一。

当决定机关：

  • 错误解释法律
  • 忽略关键证据
  • 考虑无关因素
  • 剥夺程序公正
  • 超越法律权限

就可能构成管辖权错误。

如果法院认定存在该错误，原决定可能被撤销。

 

39．在移民上诉期间我可以留在澳洲吗？

很多情况下可以，但取决于签证状态。

常见情况包括：

✔ 过桥签证A(Bridging Visa A)

允许在澳洲合法停留等待审理结果。

✔ 过桥签证B(Bridging Visa B)

允许在特定条件下出境和返回澳洲。

但需注意：

  • 并非所有过桥签证都有工作权
  • 出境可能影响签证状态
  • 条件因案件不同而异

因此必须谨慎处理。

 

40．移民上诉成功率高吗？

成功率取决于多个因素，包括：

  • 拒签或取消原因
  • 证据是否充分
  • 法律适用是否正确
  • 是否存在程序错误
  • 是否有家庭或人道因素
  • 律师提交的法律论证质量

一般而言：

  • 证据完整 + 法律理由充分 → 成功率较高
  • 资料不足或法律理由弱 → 成功率较低

每个案件必须个别分析，不能一概而论。
