Interaction between spousal support and property division in family law

Spousal maintenance and property division both fall under Part VIII of the Family Act 1975. These aspects of family law can be intertwined and often result in legal orders such as payment directions or specific property transfers. Crucially, when the court makes an order for spousal maintenance in these ways, it must clearly direct how much of the payment or property value is to be allocated to spousal maintenance. Orders granting a party exclusive rights to property, usually matrimonial, have sparked debates about their categorisation, where such an order does not change the property rights, but may temporarily change the way it is used. For spousal support and property division, the basis of the right is different. For spousal support, the needs of the applicant and the means of the respondent play a key role, whereas the division of property takes into account the contribution (both financial and non-financial) made to the assets and the relationship. It is important to remember that assessing contribution is critical for property division, but not for spousal support. Courts must address both property and support claims. An interesting aspect of property division considers needs-based factors. The so-called "support element" is designed to further adjust property considerations to ensure an equitable distribution, especially when one party may be at a financial disadvantage, for example, due to limited income opportunities or child support responsibilities.
