在維州, 結婚一般會撤銷原有遺囑. 哪些條款仍然有效, 哪些失效, 以及婚前應該做什麼.

很多伴侶同居多年後才決定結婚. 其中一方或雙方往往早已立有遺囑, 並在遺囑中稱對方為”我的伴侶”. 但很少有人意識到, 婚禮本身就會改變這份遺囑.

一般原則: 結婚會撤銷遺囑

根據維州《1997年遺囑法》 (The Wills Act 1997 (Vic))第13條, 立遺囑人結婚時, 其原有遺囑即被撤銷. 這是自動發生的, 不需要撕毀文件, 大多數人也根本不會察覺.

婚後仍然有效的部分

維州對這一原則有所放寬. 原遺囑中以下部分不會被撤銷:

  • 給予立遺囑人去世時的配偶的贈與;
  • 委任該配偶為遺囑執行人, 受託人或監護人.

遺囑的其他部分都會被撤銷. 在重組家庭中, 最重要的條款往往正在其中: 給子女和孫輩的贈與, 給伴侶子女的贈與, 配偶先去世時的後備贈與, 以及委任配偶以外的任何人為遺囑執行人.

這個缺口為什麼重要

假設一份遺囑把全部遺產留給伴侶, 並規定如果伴侶先去世, 則由雙方家庭的子女繼承. 結婚後, 給新配偶的贈與仍然有效, 但後備贈與可能已經失效. 如果配偶先去世, 或者兩人相繼去世, 遺產就可能按”無遺囑繼承”規則分配. 這些規則按固定公式執行, 並不承認未經領養的繼子女或繼孫輩.

如果原遺囑委任了律師或朋友為遺囑執行人, 這項委任同樣會被撤銷. 屆時需要有人向法院申請遺產管理書, 費用和時間都會增加.

例外: 為結婚而訂立的遺囑

為與特定人士結婚而訂立的遺囑, 不會因該婚姻而被撤銷. 在維州, 這種”預期結婚”的意圖不一定要寫在遺囑裏, 但事後再去證明, 很容易引起爭議. 更穩妥的做法是在遺囑中明確寫明: 本遺囑是為與某位指名人士結婚而訂立的.

婚前應該做什麼

  1. 檢查雙方現有的每一份遺囑.
  2. 訂立明確寫明”為結婚而訂立”的新遺囑, 或在婚後儘快簽署新遺囑.
  3. 同時檢查養老金身故受益人指定, 因為養老金不受遺囑控制 (參見我們關於養老金受益人指定的文章).
  4. 辦理持久授權書, 尤其是其中一方年紀較大或身體欠佳時 (參見我們關於股票, 資本利得税和持久授權書的文章).
  5. 如果任何一方有前段關係所生的子女, 應提前為可能的遺囑爭議做好準備 (參見我們關於重組家庭與遺囑爭議的文章).
