How to deal with cases involving the online myVCAT and RDRV portal

As a dual-qualified real estate agent and lawyer in Melbourne, our law firm regularly handles residential tenancy, retail tenancy, building and consumer law disputes that are heard in VCAT. The recent changes to VCAT allowing for online filing through their myVCAT portal for residential tenancy and consumer disputes are launching in June 2025.

Residential Tenancy disputes in VCAT and the RDRV

The Rental Dispute Resolution Victoria (RDRV) online portal system is being launched in June 2025. Its purpose is to allow for parties in matters involving bond claims, repairs, excessive rent disputes and eventually other cases to be heard before a mediator in a free process. It is likely to free up a lot of the VCAT members’ time by allowing for more disputes to be settled and enforceable through consent orders made by VCAT members. The streamlining of cases to be dealt with on the portal as opposed through email and phone is likely to make things more efficient and ensure that cases that are not hotly contested do not need to go all the way. However, cases involving interstate rental providers are still likely required to go through this early dispute resolution process before allowing the matter to be litigated in the Magistrates’ Court of Victoria. Similarly, many cases that involve parties who do not have an email address as well as people who do not have a real estate are likely to still continue to have the many challenges that are currently resulting in significant delays in resolution. It is therefore important to note that although mediation will likely help reduce the backlog of cases, there is nevertheless likely to be a longer time frame and more procedures for cases that ultimately proceed to a final hearing in VCAT’s Residential Tenancies List.

Consumer disputes through VCAT

At present, the myVCAT portal for consumer disputes is likely to make the process more efficient for consumers to make complaints about the supply of goods and services by businesses. Businesses should therefore be aware of the costs involved in dealing with these types of consumer disputes, especially where they may need leave to represent the company as one of its directors or staff. Lawyers in the consumer dispute space, particularly representing businesses, should ensure that attempts to resolve disputes are commenced well before a complaint is lodged with VCAT to reduce the need for the requirement to attend hearings and triage the matter. We are seeing larger companies updating their complaints handling policies to facilitate greater transparency in their advertising of goods, warranties available and dispute resolution processes to manage disputes. For the small businesses, we are seeing the handling of the disputes through direct contact with the manager of the store and/or owners, whereby refunds and replacements are common. There are larger disputes involving vehicles, electronic products and building supplies which appear to go to a contest hearing in VCAT.  

Register a myVCAT account

For parties to a matter, if you are not legally represented by a real estate agent (for residential tenancy disputes) or lawyers (for all VCAT disputes), you will need to register an account on myVCAT. It is important to ensure that the details are entered correctly and you have regularly access to the nominated email on the account. In this respect, the legislation and rules still apply to VCAT.
