Challenging a financial agreement (i.e. seeking to set it aside) is costly. If you do not have much money or assets, the risks of losing in court is a fundamental consideration.

  1. The Court will consider the nature and quality of a party’s claim to set aside a financial agreement, and the likely property division if the financial agreement was set aside.
  2. The legal costs in litigating to get a court ordered property division and the practicality of spending such legal costs in comparison with the likely property settlement. There is little use in the Court providing interim litigation funding order if that amount is more than what they would be entitled to. This is made even more important if parties have debts which would make orders harder to enforce and their entitlements are lower than what was in the financial agreement.
  3. The impact of utilising parties’ funds for litigation funding and its adverse impacts on the other party’s lifestyle.
  4. Lastly, a party’s likely success to set aside a financial agreement is an important consideration as to whether a Court will make a litigation funding order.
