Power of Attorney for Spain notarisation in Melbourne

Do you need a Melbourne Notary Public to notarise your power of attorney for use in Spain (escritura de poder and Escritura de Poder Especial)?

A power of attorney for Spain (escritura de poder or ) can be notarised in Melbourne by a notary public for use in Spain. Our Melbourne Public Notary will witness your signature and then notarise the power of attorney. We can also issue a separate notary certificate especially to certify documents. Please check with your lawyer in Spain about their notarisation requirements prior to contacting our office. It is important to note that the powers you can give an attorney in Spain are broad and you should go through in detail your intended outcomes before engaging a lawyer in Spain. A power of attorney gives another person authority to act on your behalf. Whether you want a family relative to do everything you want in Spain on your behalf, or you want a lawyer to do a particular task, there are different power of attorney.

Common powers of attorney granted for attorney in Spain where you want someone to:

1. Help you purchase or sell property in Spain whether that is a real property or shares including dealing with lending and Property Registries. 

2. Access your money in bank accounts to pay others. 

3. Register or cancel your utility bills. 

4. To be represented in Court, at Government Offices and at private companies. 

5. To sign contracts on your behalf. 

6. Give someone authority to deal with the Tax Authorities. 

7. To provide non-residence. 

8. Amend or revoke an existing power of attorney. 

Spain is part of the Apostille Convention so you will need to get your power of attorney stamped with an Apostille by the Department of Foreign Affairs and Trade (DFAT). We can also handle the postage to Spain if you want a more convenient service.
