← Professional executor & trustee services across Australia

Chua Tan Associates acts as independent executor, trustee and administrator for estates with assets in Queensland — Brisbane, the Gold Coast and beyond. Justin Chua sits on the mediation panel of the Land Court of Queensland, and we work with Queensland families online and through local practitioners.

Probate in Queensland

  • Grants are made by the Supreme Court of Queensland under the Succession Act 1981. Law firms file through the Queensland Courts online portal, and grants are now issued electronically.
  • A notice of intention to apply must be published in the Queensland Law Reporter and a copy given to the Public Trustee before the application is filed.
  • Overseas grants: Queensland reseals only grants from the other Australian states and territories, New Zealand and the United Kingdom. Grants from Hong Kong, Singapore, Malaysia and mainland China cannot be resealed, so an executor needs a fresh Queensland grant for Queensland assets. We prepare that application and the notarised and translated evidence.

Executor’s commission

The Supreme Court may authorise commission for a personal representative, weighing the size of the estate, the work done and how efficiently it was administered. Commission can also be paid without an order if all adult beneficiaries consent. We set out the basis of our fees in writing before you sign your Will.

New trust laws from April 2026

The Trusts Act 2025 (Qld) replaced the 1973 Act on 28 April 2026, writing trustees’ duties into statute and giving beneficiaries rights to inspect trust records. Testamentary and family trusts with Queensland trustees now operate under these rules.

When an adult loses capacity: QCAT

The Queensland Civil and Administrative Tribunal (QCAT) appoints an administrator under the Guardianship and Administration Act 2000 for up to five years. A family member, a professional such as a lawyer or accountant, or a trustee organisation can be appointed. Administrators lodge annual accounts, which for larger estates are checked by an examiner.

Where family members disagree, live overseas or have a conflict, we are available for appointment as an independent administrator. QCAT can also register orders made in other states and in New Zealand.

Family provision claims

A claimant must give the executor written notice within six months of death and start proceedings within nine months of death. These deadlines are shorter and run from a different date than in Victoria, so executors of Queensland estates need to track them carefully.

The government alternative

The Public Trustee of Queensland can act as executor or administrator. Families choose a private professional when they want a named contact, cross-border coordination and service in Mandarin or Cantonese.
