Spousal separation and parental orders in the Federal Circuit and Family Court of Australia

With social changes and the diversification of family structures, the separation of spouses has become a common phenomenon in real life. The issue of how to deal with the upbringing of children in the event of spousal separation has become a focus of attention. The Federal Circuit Court and the Family Court of Australia have ensured that children are provided with reasonable care and attention in such circumstances by making parental orders.

First, parental orders usually specify the division of labour between the parties in terms of child-rearing and responsibilities. For example, parents may agree that the father will make the major educational decisions, but on other major issues, such as health and lifestyle, both parties will have to negotiate decisions.

Secondly, parental orders will also specify the residential arrangements for the children between the parties. For example, the children may be expected to spend fortnightly periods between their parents in turn, to ensure that both parties are able to spend sufficient time with their children.

Once again, parental orders will often include special arrangements to cater for special holidays or occasions. For example, on Mother's Day and Father's Day, as well as on both parties' birthdays, the children may spend a full day with their mother or father, respectively.

Finally, for special holidays, such as Christmas, the parental order may provide for the children to spend the holiday with both parents, but the schedule will rotate from year to year.
