When you have been charged with a serious criminal offence, you may be detained whilst your case is pending or a Judge may grant you bail subject to various conditions. The main consideration of the Courts is whether a defendant should have his/her liberty granted by being granted bail compared with them being an unacceptable risk to the community. Specifically, the key concerns you must satisfy are why you are not a flight risk and/or will not cause harm to others. In addition, you want to consider what conditions you can agree to which will address the Court’s concerns. It is always better to be outside than inside prison so providing a surety will help significantly.

There is now a presumption that a person will not be granted bail for more serious charges, including rape, kidnapping, armed robbery, intentionally or recklessly causing serious injury with gross violence, dangerous driving offences and persistent contravention of family violence intervention orders. A criminal law solicitor will talk with the Prosecution to find out what conditions they would want if the Magistrate grants bail and more importantly make submissions with supporting evidence in seeking bail being granted.
