The role of a Melbourne Notary Public
A Melbourne Notary Public plays an important role in a world where every country has different laws and forms of documents. A Notary Public, Public Notary or Notary is a senior lawyer recognised under international law as having the ability to verify a signatory’s identity and authenticate documents for production overseas. In other words, the documents are legally valid and recognised in another country. This means a Notary Public has a special task of ensuring that trust and fidelity is present in the use of legal documents internationally, and is best represented by the official stamp and Notarial Seal which are placed on notarised documents. As a Melbourne Notary Public, we service clients mainly from metropolitan Melbourne and country Victoria.
Making the process simple
The process of notarising documents can be quite complex as there are many procedures to follow and the process can be quite tedious. At Chua Tan Associates, a Melbourne Notary Public Firm, all you need to do is call or email us and we will help you notarise your documents efficiently. We notarise many documents daily and we can help you navigate your notarisation requirements. From answering questions, to providing quotes, we are very flexible and accommodating of your timeframe and requirements. Our work is professional, efficient and straightforward so you can feel rest-assured your notarised documents can be used in your intended country.
Apostille or Authentication
Your documents will require either apostille or authentication. We can arrange for an administration fee to complete the Authentication or Apostille stamp with the Department of Foreign Affairs & Trade (DFAT).
Authentication for Asian countries
We have an extensive Notary Public practice servicing individuals who require authentication of notarised documents with consulates in Melbourne and embassies in Canberra for Asian countries. Our experience and working relationship with local consulates means your documents can be authenticated and sent out to you fast. We are able to hand deliver notarised documents if required. In addition, our Notary Public can speak Mandarin and Cantonese so can assist you if you require authentication for use in China, including in Hong Kong and Macau.
Witnessing signatures
We can sign pre-prepared forms you bring to your appointment, ranging from property documents, bank account form, power of attorney, affidavit, court documents and other foreign legal documents which are to be used in another country. Please bring 100 Points of ID with at least one piece of identification with a photo and signature. We prefer you bring your passport for ID verification purposes. You can also bring your driver’s license, overseas identity cards, medicare card and credit cards. If you want to know what documents you need to bring, please contact our office.
True copies
We can certify that copies of documents are authentic and true copies of the original, if you need to produce the certified copies in another country. We may complete a covering Notarial Certificate for a bundle of documents.
You will need to bring the original documents to be inspected and a copy of the original documents. Our Notary Public Melbourne must be able to witness the original document. If you only have an original document that was issued electronically, then we will need to confirm the originality of the document by making further enquiries. Please bring additional money to appointments if you require extra copies of originals as quoted.
Unsigned forms
As a Notary Public, we are required to sign documents when we are both present so you must not sign any forms prior to coming to us. You can still complete all the other details on the forms that you want us to notarise, but do not sign the documents.
Notarial Certificates
At times it might be necessary to have a notarial certificate for every document whilst many times it is sufficient to bind all documents in one Notarial Certificate bundle. What choice to make about using Notarial Certificates will depend on your situation and it is best to email or call us for more information.
Making an appointment before coming to our office
You should always book a time to see our Melbourne Notary Public before coming to our office as we usually have multiple appointments back to back. But we can always try to squeeze you in if there is available time and you are happy to wait.
Which persons should come to the appointment
Who comes to the appointment to get documents notarised will depend on the purpose of the documents. Please email or call our office to discuss your individual case if the person who needs the document is not available.
Powers of Attorney
Everyday we notarise clients’ Powers of Attorney for people in Australia who want someone overseas to do something for them. A Power of Attorney used overseas needs a Notary Public to notarise the document. All countries have their own requirements in the form and content as well as the witnessing requirement. You can call us if you have any questions and we can assist you in notarising your Power of Attorney to be used in any country. Before you come to us, it is important to seek advice from your overseas lawyer so you do not waste time and money rectifying issues which are easily avoidable.
Letter of Consent for Children to Travel
We can notarise the parental consent form so that your child(ren) may travel to your desired countries when they are travelling with only one parent or by themselves. We require the parent(s) not travelling with the child to confirm and sign in the presence of our Notary Public Melbourne that the child’s travel plans have been agreed to and it is known that the child will be travelling with the other parent or a third party adult such as a family relative. You can contact your Consulate or Embassy to obtain the appropriate Parental Consent form.
