Most people who get involved with the police and are charged have never been to court before. They feel stressed and believe a lawyer can solve all their problems, i.e. get the charges dropped and/or have the Judge or Jury find the defendant not guilty. However, in reality a lawyer’s job is to challenge the prosecution when not all elements of an offence are made out and the police’s evidence to support a prosecution have problems. It does not involve making unrealistic promises to clients as unrealistic expectations lead to disappointment.

If there are any problems with the evidence, both in how it was obtained and what it goes to prove, the lawyer can challenge the evidence and have it removed from the case or persuade the judge to put less weight on it. Similarly, if there are issues with proving the elements of the offence it is important to make sure that the Judge understands that there are holes in the prosecution’s case. This all goes to argue there are enough doubts in the case to justify a finding of no guilt.

Ultimately, a lawyer’s job is to ensure that any prosecution case against a defendant meets all the elements of the offence and follows correct procedure, and to raise arguments and challenge the police evidence.
