Visa Refused in Australia? How to Appeal to the ART: Process, Deadlines and Next Steps

Which visa refusals can be appealed, how the deadline is counted, the ART review process step by step, and what to do if the appeal fails.

Short answer: Most visas refused in Australia, and some overseas visas with an Australian sponsor, can be reviewed by the Administrative Review Tribunal (ART) if you apply within the deadline in your refusal letter; the deadline runs from when you are taken to have received the decision, is usually only weeks or days, and generally cannot be extended. If the ART affirms the refusal, you can apply to the Federal Circuit and Family Court for judicial review of a legal error within a strict time limit, but the court cannot grant the visa itself.

If the Department of Home Affairs has refused your visa, the first thing to do is read the decision letter for your review rights and the deadline, not lodge a fresh application. Most visas refused in Australia, and some offshore visas with an Australian sponsor (such as partner visas), can be reviewed by the Administrative Review Tribunal (ART), which replaced the AAT in October 2024. The time limit is short and the Tribunal generally cannot extend it.

Key points

  • Your decision letter says whether you can seek review, where, and by when.
  • Time runs from the day you are taken to have received the decision. Some limits are days, most are a few weeks.
  • The application must be lodged online and the fee paid within the time limit, or it is invalid.
  • Your bridging visa usually continues during the review, but check its work and travel conditions.
  • The ART looks at the whole application again, so you can give new evidence.

Which refusals can be appealed to the ART?

In general, visas applied for and refused in Australia (skilled, employer-sponsored, graduate, student, partner and others) can be reviewed, as can some offshore visas where the sponsor is in Australia, such as offshore partner and some family visas. Most offshore visitor visas have no review right. Character refusals and cancellations under section 501, protection visas and refused employer nominations follow different rules and deadlines.

Cancellations have their own review pathways, separate from refusals. The safest course is to have a lawyer read the decision letter line by line.

The time limit: where most appeals go wrong

The deadline is counted from when you are deemed to have received the decision, not when you opened the email. Email, ImmiAccount and post each have different deemed-receipt rules. Decisions made while you are in detention or on character grounds can have limits of only a few days. For most migration reviews the ART has no power to extend time.

The ART appeal process, step by step

  1. Read the decision letter to confirm the review right, who must apply (you or your sponsor) and the deadline.
  2. Lodge the review online with the ART before the deadline, attach the decision and pay the fee (a partial reduction is available for financial hardship).
  3. Check your bridging visa status and conditions, especially work rights and travel.
  4. Obtain the Department’s file so you know what it relied on and why the visa was refused.
  5. Prepare written submissions and new evidence answering each reason for refusal.
  6. Attend the hearing, usually before a single member. Mandarin and Cantonese interpreters can be arranged.
  7. Receive the decision: the ART can affirm the refusal, set it aside and send it back to the Department, or substitute its own decision.

If the ART appeal fails

You may be able to seek judicial review in the Federal Circuit and Family Court of Australia. Judicial review only looks for legal error, not the merits, and the time limit is again short. In limited cases a request for Ministerial intervention is possible, but the Minister does not have to consider it. Whether it is worth going further depends on the Tribunal’s reasons.

Why get a lawyer for the appeal

The review is often your last chance to give evidence and be heard in person. Appeals commonly fail because the reasons for refusal were not answered one by one, the evidence was inconsistent, the deadline was missed, or answers at the hearing did not match earlier documents.
