Criminal law – prevention and identifying risk factors are key

Home » 澳洲法律解读 » 刑法 » Criminal law – prevention and identifying risk factors are key

Dealing with criminal charges often comes at the worst time of people’s lives. Moreover, findings of guilt can lead the Court to impose punishments on people, including imprisonment and fines. In addition, after a convicted person has served their sentence, they may find it difficult to obtain employment and travel overseas, reducing their lifestyle further. Consequently, it is important to take preventative action to ensure that you reduce the risk of situations getting out of control. One of way of avoiding getting into trouble with the law is to identify risk factors which might lead to criminal offending. Some risk factors to be aware of include:

1. Intoxication

If you have been drinking alcohol or consuming illicit substances, understand that you are likely to lose inhibitions and be more prone to violence. Often in sentencing pleas, an accused person outlines the circumstances of offending in which alcohol consumption had played a significant part in the criminal offending. It is therefore important to understand your limits when it comes to alcohol consumption as well as understand how your behaviour changes when you are drunk. It goes without saying that you should avoid consuming illicit drugs. Nevertheless, the Courts are very lenient towards persons found with drugs in their possession or in their system if it is their first time in the judicial system and they show genuine remorse. In general, if you know you might become more rowdy or passionate once intoxicated, then understand when you should limit yourself and have someone watch over you.

2. Anger

If you have a tendency to act rashly when angry, consider how to best manage your emotions to reduce the chance you might cause harm to others. There are various online resources which help one manage emotions and support services available at low cost.

3. Greed

Greed is a common factor in drug trafficking and theft offences. It comes from a desire to gain wealth outside the established rules of society, often quickly and without remorse for those impacted by the conduct. Many cases start with people getting rewarded for their illicit efforts in small quantities and then progressively larger in monetary gain over time.

Being charged with criminal offending has serious consequences. Depending on how serious the criminal charges are, a finding of guilt can result in imprisonment, large fines and heavy restrictions in a person’s conduct in life. For individuals who are not Australian citizens, it can result in the cancellation of permanent or temporary visas and eventual deportation from Australia. Therefore, it is important to seek legal advice as soon as you are caught up with law enforcement/the police.

Chua Tan Associates has extensive experience resolving criminal matters for clients, getting clients great outcomes based on their situation including lesser punishments, cases dropped by police, matters struck out of court and findings of innocence. Should you run into trouble with the police, book a consultation with our criminal law solicitors for practical advice on your criminal charges.
