Separation is hard. When the financial outcome is agreed or ordered, one more task remains. The Victorian property must actually change hands.

That step is a property transaction, not only a family law matter. It involves the title, the bank, the State Revenue Office and sometimes a sale. Mistakes here can cost money and delay a clean break.

This guide explains the process in general terms. Chua Tan Associates acts only on property located in Victoria. Our clients may live anywhere in the world.

The agreement is not the transfer

Many people believe the deal is done once orders are made. In practice, consent orders, court orders or a binding financial agreement only set out what should happen. The title still shows the old owners until a transfer is registered.

Implementing the outcome usually involves preparing transfer documents and lodging them electronically with Land Use Victoria. It may also involve discharging or replacing a mortgage. Each step has its own requirements and timing.

Orders and agreements often contain deadlines and conditions. Read them carefully with your lawyer before you start. Missing a condition can cause disputes or a return to court.

Victorian duty: an exemption or concession may apply

A transfer of Victorian land normally attracts land transfer duty. However, Victorian law may provide an exemption or concession for transfers made under family law orders or certain financial agreements. This can make a significant difference.

Conditions apply. The exemption generally depends on the type of order or agreement, who receives the property and how the documents are drafted. Transfers to third parties, companies or trusts may be treated differently.

The State Revenue Office decides whether the exemption applies. It usually needs supporting documents. Rules change, so obtain advice on your situation before signing.

Refinancing and releasing one party from the loan

Most separating couples hold a joint mortgage. Transferring the title does not remove a party from the loan. The bank must agree to release that person.

Usually the party keeping the property applies to refinance in their sole name. The lender assesses that person’s income, debts and circumstances. Approval is not guaranteed.

If the bank will not approve, options may include a different lender, a guarantor, more time or a sale. Some orders already say what happens if refinancing fails. Check this early so there are no surprises.

Selling the property instead

Sometimes selling is the clearest path. Both parties are released from the loan, and the net proceeds are divided as agreed or ordered. It can also reduce ongoing conflict.

A sale still needs cooperation. Both owners usually sign the contract and the transfer. Agreeing on the agent, price and handling of proceeds in advance avoids later arguments.

Your conveyancing lawyer can hold settlement funds and pay them out as the orders direct. This gives both sides confidence the money is handled correctly.

Land tax and capital gains: points to raise early

Land tax depends on ownership and use. A change in ownership or a move out of the home can change your land tax position. Overseas owners may face additional rules.

Capital gains tax may also be relevant. Australian law may offer rollover relief for transfers made under certain family law orders or agreements. This can defer, not remove, tax on a later sale.

These are general points only. Speak with your accountant or tax adviser alongside your lawyer. Getting the structure right before transfer is far easier than fixing it later.

Caveats and protecting your interest before orders

Before orders are made, one party may fear the other will sell or mortgage the property. A caveat on the title can sometimes help. It warns others that a person claims an interest in the land.

A caveat must be based on a proper caveatable interest. Lodging one without a proper basis can expose you to a claim for compensation. Family law courts can also make orders to protect property.

Obtain advice before lodging or challenging a caveat. The right step depends on how title is held and what stage the matter has reached.

Parents’ money in the property

Many Asian families help their children buy a home. On separation, a key question is whether that money was a loan or a gift. The answer can affect how the property is treated.

Clear documents made at the time of purchase help greatly. Without them, disputes over parents’ contributions can become long and stressful. Read our guide, Parents helping children buy property: loan or gift?, for more detail.

When one party lives overseas

It is common for one former partner to live in China, Hong Kong, Malaysia, Singapore or elsewhere. Victorian transfer documents can often be signed overseas. Identity checks and witnessing rules must still be met.

Some documents may need to be signed before a notary or an Australian consular official. Our in-house notary public can advise on what is acceptable. Planning ahead avoids rejected documents and courier delays.

An overseas party may also have foreign tax or reporting obligations. These should be checked with a local adviser.

Coordinating with the other lawyer and overseas practitioners

A transfer after separation involves two sides. We coordinate with the other party’s lawyer on documents, timing and settlement. Clear communication keeps the process moving.

Where there are related proceedings or assets abroad, we can liaise with family law practitioners overseas. This helps ensure the Victorian step fits the wider outcome.

Chua Tan Associates also has family law and mediation capability. If agreement has not yet been reached, mediation may help. For broader issues, see our cross-border separation and divorce guides.

Concerns we often hear from Asian families

“I live overseas. Can this be done without flying to Melbourne?” Often, yes. We work across time zones and arrange signing and witnessing abroad where the rules allow.

“I don’t understand Australian property law. How do I avoid mistakes?” We explain each step in plain Mandarin, Cantonese or English. You will know what you are signing and why.

“My parents put money into this home. Will they lose it?” That depends on the facts and the documents. We review the history carefully and explain the general position.

“I want this handled quietly, without family conflict.” We act with discretion. Our approach is calm and focused on completing the transfer cleanly.

“Can one firm handle the property, the will and family issues together?” Yes. We can update your will after separation and coordinate property, family law and estate matters under one roof.

Illustrative example, not a real case: A couple separates. Under consent orders, one party in Melbourne keeps the apartment and must refinance. The other party lives in Shanghai. We would confirm duty treatment, coordinate the refinance and arrange overseas signing so the transfer and loan release complete together.

Why Asian families choose Chua Tan Associates

Our lawyer Tan Chua has more than three decades of experience in Victorian property law. She has guided many families through transfers, refinancing and complex settlements.

The real value of good advice is the costly mistake you avoid. An unclaimed duty exemption, a failed refinance or a rejected overseas signature can cost far more than careful planning.

  • One firm for property, wills and estates, family law and immigration

What if my former partner will not sign the transfer? Options may exist under the orders or through the court. Seek advice promptly.

Can I sign the documents from overseas? Usually, yes, if identity and witnessing requirements are met. We advise on the right process.
