Chua Tan Lawyers Pty Ltd (ACN 613 093 182), trading as Chua Tan Associates (“we”, “us”, “our”), respects your privacy. This policy explains how we collect, use, disclose and protect personal information, consistent with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and with our professional obligations of confidentiality as lawyers.
1. What personal information we collect
- Contact details, such as your name, email address, phone number, WeChat or WhatsApp ID, and country of residence.
- Information about your enquiry or legal matter, including information about other people involved.
- Identity documents and other information we need to verify your identity or act for you (for example, passports, visas, company or property records).
- Appointment and payment details when you book a consultation (card payments are processed by a third-party payment provider; we do not store your full card number).
- Information about how you use our website, such as pages visited, device and browser type, and the advertisement or link that brought you to us.
Some information you give us may be sensitive information (for example, about your health, family circumstances or immigration history). We only collect it with your consent and where it is reasonably necessary for your matter, or where the law permits.
2. How we collect it
We collect personal information directly from you when you contact us by phone, email, WeChat or in person; complete an enquiry form or book a consultation on our website; or submit your details through an enquiry form in one of our advertisements on Facebook, Instagram or Google. We may also collect information from third parties where you have authorised it or it is needed for your matter, such as other parties, government agencies, courts, registries and other professionals.
3. Why we use it
- To respond to your enquiry and arrange consultations.
- To provide legal and notarial services, including conflict checks and identity verification.
- To bill and administer our services and meet our legal, regulatory and insurance obligations.
- To measure and improve our website and advertising.
- To send you updates about legal developments or our services, if you have agreed. You can opt out at any time.
4. Cookies, analytics and advertising
Our website uses cookies and similar technologies, including Google Analytics, Google Ads conversion tracking and the Meta Pixel. These tools tell us, for example, when someone who clicked one of our ads submits an enquiry, taps our phone number or books a consultation, so we can measure which advertising is useful. Google and Meta may use this information in accordance with their own privacy policies. You can control cookies through your browser settings, manage ad preferences in your Google and Meta account settings, or opt out of Google Analytics using Google’s browser add-on.
5. Who we disclose it to
We keep client information confidential. We only disclose personal information where it is needed for your matter or permitted by law, for example to:
- courts, tribunals, government departments and registries (such as the Department of Home Affairs or Land Use Victoria);
- barristers, migration agents, accountants, translators and other professionals engaged on your matter;
- our IT, website hosting, email, booking, payment and practice-management service providers;
- our professional indemnity insurers and regulators, where required.
We do not sell personal information.
6. Overseas disclosure
Many of our clients live outside Australia, and some matters involve people, assets or authorities overseas. We may therefore disclose personal information to recipients in other countries, including Hong Kong, Taiwan, mainland China, Singapore, Malaysia and the United States. Some of our service providers (including Google and Meta) may store or process information outside Australia. We take reasonable steps to ensure overseas recipients handle personal information appropriately.
7. Security and retention
We take reasonable steps to protect personal information from misuse, loss and unauthorised access, including access controls and secure storage. We keep client files for the periods required by law and our professional obligations, and then securely destroy or de-identify them.
8. Access and correction
You may ask to access or correct the personal information we hold about you by contacting us. We may need to verify your identity, and in limited circumstances (for example, where legal professional privilege or another person’s privacy is involved) we may decline access and will explain why.
9. Complaints
If you have a concern about how we have handled your personal information, please contact us first and we will respond within 30 days. If you are not satisfied, you may contact the Office of the Australian Information Commissioner at www.oaic.gov.au or on 1300 363 992.
