If you have been accused of a criminal offence and you believe you are innocent, consider undertaking the following steps:

1. Understand the law- the police/prosecution and Court view these matters by looking at the law and comparing it with the facts of each case. You want to understand the specific charges laid against you and understand what elements constitute that offence.

2. Understand the facts- there are a lot of mitigating circumstances which go to prove or disprove a case. You want to understand what a third party such as a Judge or Jury might find reasonable to listen to and accept and consider the implications of each fact.

3. Understand the strength and use of each piece of evidence- evidence needs to be relevant and go to support or weaken the case. Evidence might be used to prove or disprove you completed each element of the offence and it can also be used to show the Court that other mitigating circumstances were present. In addition, how strong the evidence is depends on how objective and reliable it is to other people.
